TIAL PRODUCTS TERMS & CONDITIONS

Purchasing from or placing an order with Tial Products constitutes the acknowledgment and acceptance of all terms and conditions listed below.  Tial Products reserves the right to make changes to its terms and conditions at any time.

PRICES  All prices provided do not include shipping & handling charges.  All prices and descriptions are subject to change without notice.

TYPOGRAPHICAL ERRORS  Tial Products reserves the right to refuse or cancel orders resulting from typographical or pricing errors including those already confirmed or paid.  In cases where payment has been processed, a prompt refund will be issued.

WARNING  Goods are at the risk of the customer as soon as they are delivered by Tial Products to the customer.  All parts sold by Tial Products, except for street legal/DOT approved parts, are racing parts for off road use only.  Federal and many State laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting the vehicle emission or safety in a vehicle used on public highways.  Violation of such laws may subject the owner or user to a fine or penalty.  Installation of product may void the warranty coverage, if any, on a vehicle.  Tial Products shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor.  Tial Products shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part.  Tial Products will not cover any loss in profit or labor due to errors in shipping, improper packaging, and/or extended delays for backorder items.  Tial Products shall not be held accountable for any misconception or disappointment associated with any product.  Installation of Tial Products should not be attempted by anyone without the necessary experience or expertise to do so.

SPECIAL ORDERS  Tial Products will determine special order items.  All special ordered items must be prepaid before processing the order.  Special ordered items cannot be cancelled or returned.  Ordered items must be picked up or shipped within 30 (thirty) days after the order is filled.  Orders not picked up within thirty days will be forfeited and will become property of Tial Products.  No refunds will be given on orders that are not picked up within this thirty-day period.

CANCELLATIONS OR CHANGES  Any order which is cancelled or changed with Tial Products after 24 hours from placement of order to the time of shipment may be subject to a fee of up to 10% (ten percent).

PAYMENT  Terms will be determined at time of invoicing.  Tial Products accepts all major credit cards, ACH debit, ACH credit, or cash.  A credit card fee of 3.5% will be apply for credit card orders.  All orders paid by credit card must be shipped to the cardholder’s billing address or verified alternate shipping address.  Tial Products does not accept checks.

SHIPPING  Tial Products determines the final shipping method during invoicing, utilizing UPS, USPS, FedEx, or freight forwarders.  Drop-shipping is available for a $14 fee per request.  Please note that while we strive for timely delivery, all shipping dates are estimates and Tial Products is not responsible for carrier delays.

INTERNATIONAL ORDERS  All orders outside of the United States must be paid in full in US Funds before any order will be processed.  Methods of payment include bank wire transfer or other electronic payment services such as Wise or Revolut.

REJECTION OF GOODS  As soon as the goods are delivered to the Buyer, the Buyer shall inspect them.  Notice in writing must be given within fourteen (14) days after receipt of goods of any defect or omissions.  Failure to give notice within fourteen (14) days after receipt shall constitute an irrevocable acceptance of the goods.

CLAIMS  Defective goods, shortages, delays, or failures in shipment or delivery, or for any other cause, shall be deemed waived and released by Buyer, unless made in writing within fourteen (14) days after the arrival of the goods.

RETURNS  All items returned are subject to a 15% (fifteen percent) restocking fee.  Returns are not accepted for special orders and custom orders.  All other returns or exchanges are accepted within 14 days after date of invoice.  It is the customer’s responsibility to contact Tial Products within this time period to be eligible for a return.  A Return Material Authorization Number must be issued before returning product.  Contact Tial Products by phone or e-mail for a Return Material Authorization Number (RMA #).  The RMA # must be clearly marked on return packages, otherwise the package may be refused.  All returns must be unused, in the same condition as sold to buyer and in the original packaging.  The returned item(s) must be accompanied with a copy of the original invoice.  No returns or exchanges will be allowed if the item shows signs of having been installed, scratched, damaged or modified.  If Tial Products does not accept a returned item as being defective and/or returnable for any reason, the buyer must accept any incurred cost.  It is the responsibility of the customer to verify the correct part before ordering.

REFUNDS  A refund or exchange will not be made until all items are returned to Tial Products.  Shipping and handling charges are non-refundable.  Orders placed by credit card will be refunded to the same credit card account only.  All other non-credit card orders will be refunded by account credit or electronic payment.  Refused shipments sent back to Tial Products do not constitute a refund or credit.  Tial Products reserves the right to charge the customer shipping & handling costs for the refused shipment and a 15% restocking fee.

WARRANTY  Tial Products warranty that goods shall be free of defect in workmanship and components.  Tial Products offers a warranty for the repair or replacement for a period of 24 months from the date of purchase to the original customer or Tial Products offers a warranty for the repair or replacement for a period of 24 months after delivery to the user/purchaser.  Tial Products will inspect the returned part.  If the inspection reveals that the part is defective due to faulty workmanship or components, it will be replaced or repaired at no charge to the customer/user/purchaser including the cost of return standard shipping.  Expedited shipping will be at the expense of the customer.  The warranty will be void if the inspection reveals mishandling, abuse or faulty installation as the cause of the defect.  The Warranty does not cover the cost of any labor or materials incurred by the customer/user/purchaser to remove or reinstall the product.  All other liabilities such as (but not limited to) indirect or consequential loss (including loss of profit) are expressly excluded.  The warranty is not transferable.

REFUSAL OF SERVICE  Tial Products reserves the right to refuse service to any customer who does not abide by the terms and conditions.
